GENERAL RENTAL CONDITIONS

These general rental conditions apply to all rentals of the guest room (hereinafter "the ROOM") concluded between the owner of the CAPMASIL guest house (hereinafter "the LESSOR") and the or the tenants (hereinafter “the CLIENT”).

The CUSTOMER confirms having read these general conditions when booking the ROOM.

 

1. Reservation conditions The reservation will be definitively validated upon receipt by the LESSOR of a deposit representing 50% of the total amount of the rental and will be deducted from the total invoice for the stay.

A reservation on the site "capmasil.fr" allows you to pay by:

bank card,

- bank transfer,   cash or bank check payable to LEVALLOIS   by selecting   "offline payment".

 

2. Payment of the balance The CLIENT will pay the balance of his rental upon arrival. Additional services will be payable at the end of his stay. This payment can be made in cash, by credit card, bank transfer, check (on presentation of a valid identity document).

 

3. Price The rental price of the ROOM and the services available are indicated by the LESSOR on all media accessible by the CLIENT, as well as in the rental contract.

These prices include breakfast , parking, access to the SPA area as well as charges with the exception of the tourist tax of €0.30 due per person and per night which will be paid in plus the total amount of the rental and any other services.

The LESSOR reserves the right to modify its prices at any time, which will then be applicable to reservations made after said modifications.

 

4. Arrivée – départ             Arrival: from 5 p.m. / Departure: before 11 a.m.

These times are  modifiable according to the needs   of the CLIENT with the prior agreement of the LESSOR.

 

5. Access – Security

Room access  - Each room has its own key which will be given to the CUSTOMER upon arrival. The loss of this key by the CLIENT will generate replacement costs that the CLIENT will bear in full.

Parking access  - Unsecured private parking is available free of charge on the premises. The vehicle and its contents remain the sole responsibility of the CLIENT.

 

6. Breakfasts Breakfasts are included in the room rental price. They are served in the morning and at the time agreed by the CLIENT and the LESSOR.

 

7. Covered outdoor SPA area (hot tub)  One SPA session per day is included in the price of the ROOM. Any additional session will be charged 15 euros.

Access to this space is reserved for CUSTOMERS by reservation upon arrival. Its use is under the full responsibility of the CUSTOMER who will bear any damage caused. The LESSOR cannot be held liable for any accident occurring in the SPA area. Minors must be accompanied by their parents and/or an adult having authority over them, who are solely and exclusively responsible for their custody and supervision.

More generally, each CUSTOMER undertakes to scrupulously respect all indications and instructions provided by the LESSOR regarding access to and use of the SPA area.

 

8. Reception of animals The price of this service is not included  in that of the CHAMBER. Educated and pleasant animals are allowed on request . The CLIENT will provide the animal's identification details as well as its up-to-date vaccinations. The CUSTOMER undertakes to respect the rules of hygiene, safety and conviviality of use and assumes his responsibility in the event of damage and/or accident caused by the animal.

 

9. Catering (Table d'hôtes) - The price of this service is not included in that of the ROOM.

The CUSTOMER may reserve this service 24 hours in advance and must, on this occasion, inform them of their allergies and intolerances. This catering service is taken on site with a single menu. 

 

10. Cancellation by the CUSTOMER Any cancellation must be indicated to the LESSOR in writing (postal mail/e-mail) under the following conditions:

  1. 30 days before the arrival date: the LESSOR will refund all the sums paid,

  2. more than 48 hours before the arrival date: the deposit will remain with the LESSOR,

  3. less than 24 hours before the date of arrival: the deposit will remain with the LESSOR, the latter reserving the right to request the balance of the amount of the stay.

  4. DUE TO HEALTH CONDITIONS.  If you cannot stay at your vacation spot due to total confinement or travel bans or border closures by the Government, the LESSOR guarantees you the choice between the postponement or the reimbursement of your rental (excluding booking fees)

 

11. Cancellation by the LESSOR The LESSOR pays the tenant all the sums paid. The LESSOR undertakes to inform the CLIENT of any modification and/or cancellation in writing (postal mail/e-mail).

 

12. Non-presentation of the CUSTOMER before 7 p.m. on the scheduled day, without having informed the LESSOR beforehand :

  1. The LESSOR retains the entire deposit paid and reserves the right to request the total amount of all the nights reserved with the exception of additional services not consumed,

  2. the reservation will be deemed canceled by the CUSTOMER and the LESSOR will be able to freely dispose of his ROOM.

 

13. Shortened stay The price of the rental remains entirely acquired by the LESSOR. No refund will be made.

 

14. Use of the premises The CUSTOMER must preserve the peaceful character of the rental, make use of movable property as a "good father" and show good manners in accordance with the destination of the premises.

No meals can be taken in the ROOMS.

The CUSTOMER undertakes to return the ROOMS in good condition and must declare any damage for which he may be responsible and assume the repairs.

The whole house is a non-smoking area.

The LESSOR has the freedom not to receive customers whose dress is indecent and neglected and whose behavior is noisy, incorrect, alcoholic, contrary to morality and public order.

More generally, each CUSTOMER undertakes to scrupulously respect all indications and instructions provided by the LESSOR regarding access to and use of the premises.

 

15. Accommodation capacity   If the number of CUSTOMERS exceeds the accommodation capacity of the reserved ROOM, the LESSOR

may refuse additional persons. Any termination of the contract due to this refusal will be considered at the CLIENT's initiative.

 

16. Liability of the CLIENT - Personal property – Minors - The personal property of the CLIENT is placed under his full responsibility. It is his responsibility to take all useful and necessary precautionary and safety measures for their conservation and/or for the damage that may be caused. The LESSOR cannot be held responsible in the event of loss, disappearance, theft or damage to said property. Minors present and evolving in the LESSOR's establishment are placed under the sole and entire responsibility of their parents and/or any person having authority over them.

 

17. Liability of the LESSOR Subject to the legal provisions on the subject, the LESSOR cannot bear any liability whatsoever in the event of loss, theft, injury and/or damage caused to property and/or to persons in the establishment of the LESSOR. , whatever the cause and time.

 

18. Applicable law and settlement of disputes These general conditions and any contractual relationship arising therefrom between the parties are exclusively governed by French law. For any dispute relating to the validity, interpretation, execution, non-execution, interruption and/or termination of these general conditions and of all obligations arising therefrom, the jurisdiction of the Courts will be determined in accordance with French law. .

 

19. Data-processing law et  freedom In accordance with Law n°78-17 of January 6, 1978 relating to data processing, files and freedoms, you benefit from a right of access and rectification of data concerning you. We make a commitment not to transmit in any case the information which you communicated to us with other companies or organizations.
